California Assault Weapon Identification Flowchart

The brilliant minds at www.calguns.net put together this handy flowchart to help people understand the complex assault weapon laws in California.  Using this chart you can determine if your centerfire rifle is California legal or an illegal unregistered assault weapon.

I guess "Must jump through 200 hoops" is close enough to "Shall not be infringed"..

Hence why I've turned down job offers in California. The only thing that should make a weapon illegal is to use it in an illegal fashion.

By the way, someone from a news station contacted me about your Hello Kitty rifle. Apparently some police department wants to buy one. Has anyone contacted you about it?

No, but after reading the article below I am sure they want it for training purposes:

Too bad they didn't contact me and get their facts straight before printing this article and using my copyrighted images (supplied by the Gainsville PD, no less).

Heres a question... is a rifle with a fixed magazine that holds 10 or less rounds with a flash suppressor on it considered illegal? The flow chart does not really cover this... from what i see. Or is it any weapon with a flash suppressor illegal?

Travis,

Did you not follow the flow chart? It absolutely covers what you describe.

Well here is what i see i guess... from the "Does the rifle have a detachable mag?" you go to No. From there its "more than 10 cartridges" no to that too... now its legal. on that flow direction it does not say anything about flash hiders. Only when you follow yes from the "does the rifle have a detachable mag" does it lead into flash hiders. Maybe im seeing this wrong? this is why i asked my question.

If it doesn't have a detachable magazine, there is no restriction as to what you put on it. It's only when you put a detachable magazine on it that it becomes illegal to add those things onto it.

That chart and what it represents is why i will never live in California if i can help it... My girlfriend lives in Cali. Personally i love living in Oregon because we have no bans on any small arms. With a Class 3 weapons license i could buy an M249 S.A.W., some C4 plastic explosives, a nice pink Armalite-15 with a Beta-C mag (Which holds 100 rounds and there are no restrictions on large capacity magazines at all in Oregon.), AND a nice pink silencer to go with it. I probably could also buy armor piercing rounds, though that would probably have a nice background check or something of the like. Hell i could go out and buy a .50 BMG Barrett M107 Anti-Material (Provided i actually had the money. That baby will hurt your wallet at a whopping $10,000) easier then someone can get a pistol in California. I feel sorry for any gun enthusiast that has to go through so many loopholes just to be able to have a nice firearm to take to the range and have fun or to have a personal defense measure. Even those that just want to own a few firearms to collect them i feel pity for.

If someone was to use a 3/16 dia by 3/8 long magnet as their tool in order to release the magazine, would that still keep the rifle cal legal?

Sumerian, if you ever break up with yer g/f, can I come live with you in a totally platonic relationship? (I just wanna play wit yer guns!)

So I have a Lancaster Arms NDS-3 and I was gonna replace the nice wood furniture with OD green furniture but maybe will go black instead. I saw that cheaper than dirt has a really nice looking telescoping stock for the AK that is about $100 with 8 positions and it does not fold. wait lemme check- yeah it is made by Mako and is called an AK-47 Butt Stock with Shock Absorber. I THINK that is okay to put on if my rifle still meets the overall length in its shortest configuration. I also saw a UTG Quad Rail system for the front for around $60 that might allow me to put a holo sight on and a foregrip but I THINK the foregrip is illegal since my AK DOES have a detach mag. Also, I have a MM grip on it but I was wondering, if the forward pistol grip is not under the barrel, but rather on the side (like the ikari warriors arcade game from a while back) if that is still illegal.

I am going to ask the DOJ to give me a ruling on these two items. I imagine that the forward pistol grip of ANY kind is illegal whether it is on the side of the hand guard or not, but then what about those really cool looking foregrip/bipods that spring open? those are cool, but I guess you can only install it open and I WILL NOT lock the mag on the AK. I have an AR with a bullet button (a .22 short fits in there GREAT BTW) and that is to be my varmint rifle but the AK WILL keep the 30 rnd detach mags. Any ideas or suggestions on decent furniture? I really wanted an OD Green plastic set but I broke my rear sight (popped a weld and flopped all over) in the first 50 rounds out of the box and I wanna put a lil red dot open type of holosight on it like the SIGHT MARK Mini-shot (it looks cute too!). I really want an OD green stock and OD green foregrip with rails but I guess I will settle for that all black look... :(

Very interesting this post California Assault. Assaults are quite common but severely punished offenses in the state of California. We know that situations happen where emotions are high and mistakes are made. Often, if you are facing assault and battery charges, you are instantly treated like a criminal, without being given any benefit of the doubt.

No, you are reading it correctly. If your rifle does not have a detachable mag there is no reason to ask about a flash-hider (or collapsible stock, vertical grip, etc...) because those are all OK to have as long as the mag is not detachable (requires a tool to remove it). A flow chart is designed in such a way to not ask redundant or unnecessary questions based upon the preceding answers.
